European Union Deforestation Regulation Largely 'Dismantled' Despite Initial Fanfare
Originally hailed as a pioneering law that would help stop the worldwide scourge of deforestation.
But, the final version of the European Union's anti-deforestation law, previously heralded as the flagship policy of the Green Deal, has been passed in a severely weakened state, prompting alarm from its original architect and environmental politicians.
"The regulation was hollowed out," stated the law's original author, pointing to the removal of key obligations for downstream traders to check the provenance of products like palm oil, soy, wood, beef, rubber, cocoa and coffee.
Schally cautioned that fewer obligated actors, less information collected, and imprecise sourcing details would complicate the task of authorities.
Political Dismantling
Environmental MEP Marie Toussaint was more blunt, labeling the delays, loopholes and exemptions – including one for paper goods – as the "political dismantling" of the law.
This outcome stands in stark contrast to the demands of more than a million EU citizens who supported an initiative in 2020 calling for a prohibition of deforestation-linked products.
When launched in 2021, the EU's climate chief Frans Timmermans trumpeted it as "the most ambitious law proposed to fight deforestation."
From Ambition to Compromise
The law's unravelling has been interpreted as the EU walking back its environmental promises. It faced significant delays, reportedly over technical problems, which drew condemnation.
"By reopening this file instead of solving a simple IT problem, authorities invited political interference," commented Toussaint.
Originally, the regulation required companies to trace commodities to their exact plot of land using geolocation data, holding them accountable for forest loss along their supply lines with criminal charges and hefty fines.
"It wasn't bureaucracy for its own sake," the former official said. "It was the mechanism that made the rules enforceable, established traceability, and prevented firms from obscuring their activities behind opaque production networks."
Intense Lobbying
However, the rigorous checks triggered a backlash in the EU capital from multinational corporations, producer countries, rightwing parties and member states with forestry industries.
Analysts point to last year's EU elections as a turning point, shifting the balance of power less favorable toward environmental rules.
"Additional intense pressure has come from big trading partners outside the EU," noted expert Andreas Rasche, suggesting the commission gave in to some demands in trade talks.
Key Loopholes Introduced
The passed law includes several critical weakenings:
- Retailers and traders were largely freed from conducting rigorous checks.
- A new exemption for small operators was introduced.
- A window for further "simplifications" was established for next spring.
- Only four countries – geopolitical adversaries of the EU – will face “high risk” scrutiny.
"Rather than strengthening downstream obligations, it rolled them back," said Schally. "By shifting responsibilities upstream, it reduced accountability."
Uncertainty for Companies
The delays and changes have also caused frustration for companies that prepared in advance.
"We feel very annoyed because we invested significant resources into preparing," stated a coffee company executive. "We invested in software, followed seminars and built a team... now they’re saying it could be altered again. It’s a big frustration."

A commission spokesperson supported the final law, saying: "We have listened to concerns and taken action to ensure a pragmatic and balanced application."
